These Terms & Conditions (“Terms”) govern the use of the website lifecarebiomed.com (the “Website”) and any purchase, quotation, or enquiry made through it or in connection with it. By accessing the Website or placing an order with Lifecare Medical Equipment Trading LLC (“Lifecare,” “we,” “us,” or “our”), you (“Customer,” “Buyer,” or “you”) agree to be bound by these Terms. 2. Nature of Business
Lifecare is a B2B trading and distribution company supplying medical, surgical, and healthcare equipment to hospitals, clinics, distributors, and other institutional and professional buyers across the UAE, GCC, and Africa. Products offered on the Website are intended for use by qualified healthcare professionals and institutions, unless a specific listing states otherwise. Nothing on this Website constitutes medical advice, and product descriptions should not be relied upon as a substitute for professional judgment, manufacturer instructions, or applicable regulatory guidance.
3. Product Information & Availability
We make reasonable efforts to ensure product descriptions, images, specifications, and pricing on the Website are accurate and current. However:
● Product images are for illustrative purposes and may differ slightly from the actual item (packaging, color, or minor design revisions by the manufacturer).
● Availability and pricing are subject to change without prior notice and are subject to final confirmation at the time of order.
● In the event of a listing error (incorrect price, description, or availability), we reserve the right to correct the error, cancel the order, and issue a full refund of any amount paid.
4. Quotations, Orders & Payment
Quotations issued by Lifecare are valid for the period stated on the quotation, or 15 days if no period is stated, and are subject to stock availability at the time of order confirmation.
● An order is only confirmed once Lifecare issues a written order confirmation or invoice.
● Payment terms (advance payment, credit terms, or letter of credit) will be agreed in writing on a per-customer or per-order basis.
● All prices are exclusive of VAT and shipping/customs charges unless explicitly stated otherwise.
● Lifecare reserves the right to require full or partial advance payment before dispatching any order.
5. Shipping, Delivery & Risk
● Delivery timelines provided are estimates only and depend on product availability, customs clearance, and destination.
● Risk in the goods passes to the Buyer upon delivery to the Buyer’s nominated carrier, address, or freight forwarder.
● For international (GCC/Africa) shipments, the Buyer is responsible for import duties, customs clearance, and compliance with the destination country’s import and medical device regulations, unless otherwise agreed in writing.
6. Regulatory Compliance
Medical equipment is subject to regulation in most jurisdictions. It is the Buyer’s responsibility to ensure that any product purchased is appropriately registered, licensed, or approved for use in the Buyer’s country and intended application (including, where applicable, registration with the UAE Ministry of Health & Prevention, Dubai Health Authority, or equivalent authority in the destination market). Lifecare will provide manufacturer certificates, CE/ISO documentation, or registration support where reasonably available, but final regulatory responsibility rests with the Buyer/end-user institution.
7. Warranty & Returns
● Products carry the original manufacturer’s warranty, where applicable. Warranty terms, duration, and claim procedures vary by manufacturer and product and will be provided at the time of sale.
● Due to the sensitive and regulated nature of medical equipment, products that have been used, unsealed, or where hygiene/safety cannot be guaranteed cannot be returned, except where the product is defective or non-conforming at the point of delivery.
● Claims for shortage, transit damage, or manufacturing defects must be reported in writing within 7 days of delivery, accompanied by photos and/or the delivery note.
● Approved returns or replacements will be handled directly with the manufacturer or Lifecare, as applicable, in line with the specific product’s warranty policy.
8. Intellectual Property
All content on the Website — including text, logos, product descriptions, images, and design — is the property of Lifecare Medical Equipment Trading LLC or its licensors and may not be copied, reproduced, or used without prior written consent, except for the Buyer’s own reference in the ordinary course of purchasing.
9. Limitation of Liability
To the fullest extent permitted by law, Lifecare shall not be liable for any indirect, incidental, or consequential loss (including loss of profit, business interruption, or loss of data) arising from the use of the Website or the purchase or use of any product. Lifecare’s total liability in connection with any order shall not exceed the value of that order. Nothing in these Terms limits liability for death, personal injury caused by negligence, or fraud, where such limitation is not permitted by applicable law.
10. Indemnification
The Buyer agrees to indemnify and hold Lifecare harmless from any claims, damages, or losses arising from the Buyer’s misuse of a product, failure to obtain required regulatory approvals, or use of a product outside its intended purpose or manufacturer instructions.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of the United Arab Emirates. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE, unless otherwise required by mandatory law.
12. Changes to These Terms
Lifecare may update these Terms from time to time to reflect changes in our business practices or applicable law. The updated version will be posted on this page with a revised “Last updated” date. Continued use of the Website after changes are posted constitutes acceptance of the revised Terms.
